INTRODUCTION

Wanting to look attractive and presentable is a unique feature of the human race. Industrial designs play a crucial role in enhancing the visual appeal and commercial value of products in competitive markets. In India, design protection serves as an important component of Intellectual Property Rights (IPR), safeguarding the aesthetic features of an article and encouraging innovation in the industrial sector.

This training program aims to provide participants with a comprehensive understanding of Indian design law, its practical application to the manufacturing industry, and its interface with other branches of IPR such as copyright and patents. The session will focus on equipping professionals with the knowledge and skills required to identify, protect, and enforce their industrial design rights effectively.

Keeping in this veiw, Indian Machine Tool Manufacturers' Association is orgranising a training program on Design Protection In Manufacturing : Preventing IP Theft and Imitation.


  • Introduction to Intellectual Property law, especially industrial designs
  • Basics of Industrial Design: Meaning of "Design" and "Article" under the Designs Act, 2000
  • Importance of securing design registration – Strategic advantages and commercial benefits
  • Dichotomy between copyright and design law – Understanding overlaps and legal distinctions
  • Classification of designs – India's accession to the Locarno Agreement and its implications, International perspective
  • Criteria for registration and exclusions – Novelty, originality, and features excluded from protection
  • Registration process and timelines – Filing procedures, priority applications, forms, common objections, and hearings
  • Nature of rights conferred – Scope of protection and enforceability
  • Cancellation of registration – Grounds and procedure
  • Piracy of registered designs – What constitutes infringement
  • Remedies and defences – Statutory remedies, available actions, and common defences
  • Passing off of designs – Judicial position in India, composite suits, and evolving jurisprudence

  • Understanding of the Indian Designs Act, 2000 and its interface with international design systems
  • Ability to identify protectable designs and implement filing strategies
  • Awareness of enforcement mechanisms and remedies available under law
  • Insight into best practices for avoiding infringement and handling disputes
  • Clarity on the distinction between copyright, design, and trademark protection

Managers, engineers, R&D professionals, product designers, and legal/IPR professionals from manufacturing organizations, particularly from the machine tool industry, who are involved in product design, innovation, and protection of industrial aesthetics

The programme will be delivered by Mr. Devanshu Khanna and Mr. Nagraj Hamilpure

Mr. Devanshu Khanna, Patent Attorney & IP Law Specialist

He has completed Information Technology and Law, and an LL.M. from The George Washington University Law School (U.S.). He is a registered Patent Agent and Intellectual Property Attorney with extensive experience in patent and design prosecution, litigation, and advisory. He has advised several government departments on key IP policy issues, including the 'Patentability of Computer Related Inventions' and 'Working of Patents in India'. He also assisted the Think Tank that drafted India's first National IPR Policy.  He also regularly conducts training sessions for industry and academia on patents, designs, and IP enforcement.

Mr. Nagraj Hamilpure - IMTMA

A law graduate (LLB) currently working as a Senior Executive Officer at IMTMA, Nagraj brings a unique blend of techno-legal expertise with a strong focus on Intellectual Property management. He is actively involved in designing and conducting training programmes.
